1. Agreement to Terms

By accessing and using the services of TY McAllen Concrete, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. We reserve the right to update these terms at any time, and your continued use of our services constitutes acceptance of any changes.

2. Services Provided

TY McAllen Concrete provides professional concrete installation, repair, and maintenance services for residential and commercial properties. Services include but are not limited to concrete driveways, patios, foundations, stamped concrete, walkways, pool decks, and concrete leveling. Specific project details, timelines, and costs will be outlined in individual service agreements or quotes.

3. Quotes and Pricing

All quotes provided are estimates based on the information available at the time of inspection. Final pricing may be adjusted if project conditions differ from initial assessments or if additional work is required. We will notify you of any significant price changes before proceeding with additional work. Payment terms will be specified in your service agreement and typically require a deposit before work begins with final payment due upon completion.

4. Project Timeline

We strive to complete all projects within the estimated timeframe provided. However, project timelines may be affected by weather conditions, material availability, unforeseen site conditions, or other factors beyond our control. We will communicate any delays promptly and work to minimize disruptions to your schedule. Concrete requires specific weather conditions for proper curing, and we may need to reschedule work to ensure quality results.

5. Site Access and Preparation

Clients are responsible for providing clear access to the work site and ensuring that utilities are marked before we begin work. You must inform us of any underground utilities, irrigation systems, or other hidden obstacles. We are not responsible for damage to unmarked utilities or obstacles not disclosed before work begins. Pets should be secured away from the work area for safety reasons.

6. Warranty and Guarantees

We stand behind the quality of our work and materials. Specific warranty terms will be outlined in your service agreement. Our warranty covers defects in workmanship and materials but does not cover damage resulting from improper maintenance, extreme weather events, ground movement, or misuse. Concrete is a natural material that may develop minor surface cracks over time, which are considered normal and not covered under warranty unless they affect structural integrity.

7. Client Responsibilities

Clients are responsible for maintaining newly installed concrete according to our care instructions. This includes keeping the surface clean, avoiding de-icing chemicals in the first year, and not driving or placing heavy loads on new concrete until it has fully cured. Failure to follow maintenance guidelines may void warranty coverage. You must notify us of any concerns or issues within a reasonable timeframe so we can address them promptly.

8. Limitation of Liability

Our liability is limited to the cost of the services provided. We are not liable for indirect, consequential, or incidental damages arising from our services. We carry appropriate insurance coverage for our work, and any claims must be filed within the timeframes specified in your service agreement. We are not responsible for issues arising from pre-existing conditions, soil movement, or factors outside our control.

9. Cancellation and Changes

If you need to cancel or reschedule your project, please notify us as soon as possible. Cancellations made after work has begun may be subject to charges for labor and materials already invested. Change orders must be submitted in writing and may affect project timeline and cost. We reserve the right to refuse service or cancel agreements if project conditions are unsafe or if terms are not being honored.

10. Dispute Resolution

We are committed to resolving any disputes fairly and promptly. If you have concerns about our work or services, please contact us directly so we can address the issue. If we cannot reach a satisfactory resolution, disputes will be resolved through binding arbitration in accordance with the laws of the State of Texas. Both parties agree to waive the right to a jury trial for any disputes arising from these terms or our services.
